Requirements for creating an account
In order to use our website and/or access our services, you must have the legal authority, right and freedom to enter into these terms and conditions as a binding agreement. You are not permitted to use this website and/or avail of services if this is prohibited in your country or under the laws or regulations applicable to you.

 

Commercial terms
When you purchase an item, you agree that: (i) you are responsible for reading the full item listing before committing to purchase: (ii) you are entering into a legally binding contract to purchase an item when you commit to purchase an item and complete the payment process.

The prices we charge for our products are listed on the Website. We reserve the right to change our prices for the Products displayed at any time and to correct any inadvertent pricing errors.

 

Return and refund policy
Return unused and undamaged products, together with the accessories and packaging supplied and the delivery note within 5 days of receipt of the product and we will exchange it or refund the purchase price based on the original payment method.

Reservation of the right to change the offer
We may, without notice to you, change the Services, discontinue providing the Services or any feature of the Services we offer, or impose limits on the Services. We may permanently or temporarily terminate or suspend access to the Services without notice or liability for any reason or no reason.

Guarantees and responsibility for services and products
The warranty against manufacturing and material defects is 1 year. The guarantee does not cover damage caused by accident, improper use or misuse, modification to the frame or other tampering. It is recommended to clean the glasses with soap and water and to avoid the use of solvents and alcohol.

If we receive a valid warranty claim for a product purchased from us, we will either repair the relevant defect or replace the product. If we are unable to repair or replace the product within a reasonable time, the customer will be entitled to a full refund if they return the product to us immediately. The customer is responsible for returning and paying for the product to us.

Ownership of intellectual property, copyright and logos
The Service and all materials contained therein or transmitted thereby, including but not limited to software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all related intellectual property rights, are the exclusive property of Eye-Systems. Except as otherwise expressly provided herein, nothing in these Terms creates a license in or under any such intellectual property rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from them.

Right to Suspend or Terminate Your Account
We may permanently or temporarily terminate or suspend your access to the Service without notice and without liability for any reason, including if, in our sole discretion, you violate any provision of these Terms or any applicable law or regulation. You may discontinue use and request termination of your account and/or any Services at any time. Notwithstanding anything to the contrary in the foregoing, automatically renewed subscriptions for Paid Services will not be terminated until the end of the relevant period for which you have already made a payment.

Indemnification
You agree to indemnify and hold Eye-Systems harmless from any claim, loss, liability, demand or expense (including attorneys' fees) made by any third party due to or arising out of your use of the Site or the services offered on the Site.

Limitation of Liability
To the fullest extent permitted by law, in no event shall Eye-Systems be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including, without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or in connection with the use or inability to use the Service.

To the fullest extent permitted by law, Eye-Systems assumes no liability or responsibility for (i) any errors, mistakes or inaccuracies in the Content; (ii) any personal injury or property damage of any kind resulting from your access to or use of our Service; and (iii) any unauthorised access to or use of our secure servers and/or any personal data stored therein.

 

Right to change and modify the Terms
We reserve the right to change these Terms from time to time at our sole discretion. You should therefore check this page regularly. If we materially change the Terms, we will notify you that material changes have been made to the Terms. Your continued use of the Site or our Service following any such change will constitute your acceptance of the new Terms. If you do not agree with any of these Terms or any future version of the Terms, you must not use or access (or continue to access) the Site or the Service.

 

Governing Law and Dispute Resolution
These Terms, the rights and remedies provided herein, and any claims and disputes relating to these Terms and/or the Services shall be governed in all respects solely by and construed and enforced in accordance with the substantive laws of Switzerland, without regard to its conflict of laws principles. All such claims and disputes shall be decided exclusively by a court of competent jurisdiction located in Chur, Switzerland, and you hereby agree that such shall be the case. The application of the United Nations Convention on Contracts for the International Sale of Goods is hereby expressly excluded.
